Privacy Policy

This privacy policy informs you about the nature, scope, and purpose of processing personal data (hereinafter "data") within our online offering and its associated websites, functions, content, and external online presences, such as our social media profiles (hereinafter collectively referred to as "online offering"). Regarding the terminology used, such as "processing" or "controller," we refer to the definitions in Art. 4 of the General Data Protection Regulation (GDPR).

Terminology used

 "Personal data" means any information relating to an identified or identifiable natural person (hereinafter "data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier (e.g., a cookie), or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

"Processing" means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means. The term is broad and covers virtually any handling of data.

"Pseudonymisation" means the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.

"Profiling" means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person's performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.

"Controller" means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.

"Processor" means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.


Relevant legal bases

In accordance with Art. 13 GDPR, we inform you about the legal bases of our data processing. Unless the legal basis is stated in this privacy policy, the following applies: The legal basis for obtaining consent is Art. 6 para. 1 lit. a and Art. 7 GDPR; the legal basis for processing for the performance of our services, the implementation of contractual measures, and responding to inquiries is Art. 6 para. 1 lit. b GDPR; the legal basis for processing for the fulfillment of our legal obligations is Art. 6 para. 1 lit. c GDPR; and the legal basis for processing for the protection of our legitimate interests is Art. 6 para. 1 lit. f GDPR. In the event that vital interests of the data subject or another natural person require the processing of personal data, Art. 6 para. 1 lit. d GDPR serves as the legal basis.

Security measures

In accordance with Art. 32 GDPR, taking into account the state of the art, the costs of implementation, and the nature, scope, context, and purposes of processing as well as the varying likelihood and severity of the risk to the rights and freedoms of natural persons, we implement appropriate technical and organisational measures to ensure a level of security appropriate to the risk.

These measures include, in particular, ensuring the confidentiality, integrity, and availability of data by controlling physical access to the data, as well as access, input, disclosure, ensuring availability, and separation of the data. Furthermore, we have established procedures to ensure the exercise of data subjects' rights, the deletion of data, and responses to data breaches. Moreover, we consider the protection of personal data during the development and selection of hardware, software, and procedures, in accordance with the principle of data protection by design and by default (Art. 25 GDPR).


Cooperation with processors and third parties

If, in the course of our processing, we disclose data to other persons and companies (processors or third parties), transmit it to them, or otherwise grant them access to the data, this is done only on the basis of a legal permission (e.g., if a transmission of data to third parties, such as payment service providers, is necessary for the performance of a contract in accordance with Art. 6 para. 1 lit. b GDPR), if you have consented, if a legal obligation provides for it, or on the basis of our legitimate interests (e.g., when using agents, web hosts, etc.).

If we commission third parties to process data based on a so-called 'data processing agreement', this is done in accordance with Art. 28 GDPR.

Transfers to Third Countries

If we process data in a third country (i.e., outside the European Union (EU) or the European Economic Area (EEA)), or if this occurs in the context of using third-party services or disclosing/transferring data to third parties, it will only happen if it is necessary for the fulfillment of our (pre-)contractual obligations, based on your consent, due to a legal obligation, or based on our legitimate interests. Subject to legal or contractual permissions, we will only process or have data processed in a third country if the special conditions of Art. 44 et seq. GDPR are met. This means that processing takes place, for example, on the basis of specific guarantees, such as the officially recognized determination of a data protection level equivalent to that of the EU (e.g., for the USA through the 'Privacy Shield') or compliance with officially recognized special contractual obligations (so-called 'Standard Contractual Clauses').

Rights of Data Subjects

You have the right to request confirmation as to whether data concerning you is being processed, and to access information about this data, as well as further information and a copy of the data, in accordance with Art. 15 GDPR.

In accordance with Art. 16 GDPR, you have the right to request the completion of incomplete data concerning you or the rectification of inaccurate data concerning you.

In accordance with Art. 17 GDPR, you have the right to request that relevant data be deleted without undue delay, or alternatively, in accordance with Art. 18 GDPR, to request a restriction of the processing of the data.

You have the right to receive the data concerning you, which you have provided to us, in accordance with Art. 20 GDPR, and to request its transmission to other controllers.

Furthermore, in accordance with Art. 77 GDPR, you have the right to lodge a complaint with the competent supervisory authority.

Right of Withdrawal

You have the right to withdraw consents granted in accordance with Art. 7 (3) GDPR with future effect. Right to Object: You can object to the future processing of data concerning you at any time in accordance with Art. 21 GDPR. The objection can be made in particular against processing for direct marketing purposes.

Cookies and Right to Object to Direct Marketing

Cookies are small files that are stored on users' computers. Different information can be stored within cookies. A cookie primarily serves to store information about a user (or the device on which the cookie is stored) during or after their visit to an online offering. Temporary cookies, also known as 'session cookies' or 'transient cookies', are cookies that are deleted after a user leaves an online offering and closes their browser. Such a cookie can, for example, store the contents of a shopping cart in an online shop or a login status. Cookies that remain stored even after the browser is closed are referred to as 'permanent' or 'persistent' cookies. For example, the login status can be saved if users visit the site again after several days. Similarly, user interests that are used for reach measurement or marketing purposes can be stored in such a cookie. 'Third-party cookies' are cookies offered by providers other than the controller operating the online offering (otherwise, if they are only its own cookies, they are referred to as 'first-party cookies').

We may use temporary and permanent cookies and provide information about this in our privacy policy.

If users do not wish for cookies to be stored on their computer, they are asked to deactivate the corresponding option in their browser's system settings. Stored cookies can be deleted in the browser's system settings. The exclusion of cookies may lead to functional limitations of this online offering.

A general objection to the use of cookies for online marketing purposes, especially in the case of tracking, can be declared for many services via the US website http://www.aboutads.info/choices/ or the EU website http://www.youronlinechoices.com/ . Furthermore, the storage of cookies can be prevented by deactivating them in the browser settings. Please note that in this case, not all functions of this online offering may be available.

Deletion of Data

Data processed by us will be deleted or its processing restricted in accordance with Art. 17 and 18 GDPR. Unless expressly stated otherwise in this privacy policy, data stored by us will be deleted as soon as they are no longer required for their intended purpose and no legal retention obligations prevent their deletion. If data is not deleted because it is necessary for other legally permissible purposes, its processing will be restricted. This means that the data will be blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax law reasons.

In accordance with legal requirements in Germany, data is retained for 10 years, in particular, pursuant to §§ 147 (1) AO, 257 (1) No. 1 and 4, (4) HGB (books, records, management reports, booking vouchers, commercial books, documents relevant for taxation, etc.) and for 6 years pursuant to § 257 (1) No. 2 and 3, (4) HGB (commercial letters).

In accordance with legal requirements in Austria, data is retained for 7 years, in particular, pursuant to § 132 (1) BAO (accounting records, receipts/invoices, accounts, vouchers, business papers, statement of income and expenses, etc.), for 22 years in connection with real estate, and for 10 years for documents related to electronically supplied services, telecommunications, broadcasting, and television services provided to non-entrepreneurs in EU member states for which the Mini One Stop Shop (MOSS) is utilized.

Business-Related Processing

Additionally, we process
- Contract data (e.g., subject matter of the contract, term, customer category).
- Payment data (e.g., bank details, payment history)
from our customers, prospective customers, and business partners for the purpose of providing contractual services, service and customer care, marketing, advertising, and market research.

Order Processing in the Online Shop and Customer Account

We process our customers' data within the scope of order processes in our online shop to enable them to select and order chosen products and services, as well as to facilitate their payment and delivery or execution.

The data processed includes inventory data, communication data, contract data, payment data, and the data subjects affected by the processing include our customers, prospective customers, and other business partners. The processing is carried out for the purpose of providing contractual services within the operation of an online shop, billing, delivery, and customer services. In this context, we use session cookies to store shopping cart contents and permanent cookies to store login status.

Processing is carried out on the basis of Art. 6 Para. 1 lit. b (execution of order processes) and c (legally required archiving) GDPR. The information marked as required is necessary for the establishment and fulfillment of the contract. We only disclose data to third parties within the scope of delivery, payment, or legal permissions and obligations towards legal advisors and authorities. Data will only be processed in third countries if this is necessary for the fulfillment of the contract (e.g., at the customer's request for delivery or payment).

Users can optionally create a user account, allowing them to view their orders, among other things. During registration, users will be informed of the mandatory information required. User accounts are not public and cannot be indexed by search engines. If users have terminated their user account, their data related to the user account will be deleted, provided that their retention is necessary for commercial or tax law reasons in accordance with Art. 6 Para. 1 lit. c GDPR. Information in the customer account remains until its deletion, followed by archiving in the event of a legal obligation. It is up to the users to secure their data upon termination before the contract ends.

During registration, re-logins, and the use of our online services, we store the IP address and the time of the respective user action. This storage is based on our legitimate interests, as well as the users' interest in protection against misuse and other unauthorized use. As a rule, this data is not passed on to third parties, unless it is necessary for the assertion of our claims or there is a legal obligation to do so in accordance with Art. 6 Para. 1 lit. c GDPR.

Deletion occurs after the expiry of statutory warranty and comparable obligations; the necessity of data retention is reviewed every three years. In the case of statutory archiving obligations, deletion takes place after their expiry (end of commercial law (6 years) and tax law (10 years) retention periods).

External Payment Service Providers

We use external payment service providers through whose platforms users and we can carry out payment transactions (e.g., each with a link to the privacy policy: Paypal (https://www.paypal.com/de/webapps/mpp/ua/privacy-full), Klarna (https://www.klarna.com/de/datenschutz/), Skrill (https://www.skrill.com/de/fusszeile/datenschutzrichtlinie/), Giropay (https://www.giropay.de/rechtliches/datenschutz-agb/), Visa (https://www.visa.de/datenschutz), Mastercard (https://www.mastercard.de/de-de/datenschutz.html), American Express (https://www.americanexpress.com/de/content/privacy-policy-statement.html)

In the context of fulfilling contracts, we use payment service providers based on Art. 6 Para. 1 lit. b GDPR. Furthermore, we use external payment service providers based on our legitimate interests pursuant to Art. 6 Para. 1 lit. f GDPR, to offer our users effective and secure payment options.

The data processed by the payment service providers includes inventory data, such as name and address, bank details, such as account numbers or credit card numbers, passwords, TANs, and checksums, as well as contract, sum, and recipient-related information. This information is necessary to carry out the transactions. However, the entered data is processed and stored only by the payment service providers. This means we do not receive any account or credit card-related information, but only information confirming or denying the payment. Under certain circumstances, data may be transmitted by the payment service providers to credit agencies. This transmission is for identity and creditworthiness checks. For this, we refer to the terms and conditions and privacy notices of the payment service providers.

For payment transactions, the terms and conditions and privacy notices of the respective payment service providers apply, which are available on their respective websites or transaction applications. We also refer to these for further information and for asserting rights of withdrawal, access, and other data subject rights.

Administration, Financial Accounting, Office Organization, Contact Management

We process data in the context of administrative tasks, the organization of our operations, financial accounting, and compliance with legal obligations, such as archiving. In doing so, we process the same data that we process in the course of providing our contractual services. The legal bases for processing are Art. 6 Para. 1 lit. c GDPR and Art. 6 Para. 1 lit. f GDPR. Customers, prospective customers, business partners, and website visitors are affected by this processing. The purpose and our interest in the processing lie in administration, financial accounting, office organization, and data archiving – tasks that serve to maintain our business activities, perform our duties, and provide our services. The deletion of data with regard to contractual services and contractual communication corresponds to the information specified for these processing activities.

In this context, we disclose or transmit data to the tax authorities, consultants such as tax advisors or auditors, as well as other fee collection points and payment service providers.

Furthermore, based on our business interests, we store information about suppliers, organizers, and other business partners, for example, for the purpose of future contact. These predominantly company-related data are generally stored permanently.


Business Analyses and Market Research

To operate our business economically and to identify market trends, as well as the wishes of contractual partners and users, we analyze the data available to us regarding business transactions, contracts, inquiries, etc. We process inventory data, communication data, contract data, payment data, usage data, and metadata based on Art. 6 Para. 1 lit. f GDPR, with data subjects including contractual partners, prospective customers, clients, visitors, and users of our online offering.

The analyses are carried out for the purpose of business evaluations, marketing, and market research. In doing so, we may consider the profiles of registered users with information, e.g., about the services they have used. The analyses serve to increase user-friendliness, optimize our offerings, and improve business efficiency. These analyses are solely for our internal use and are not disclosed externally, unless they are anonymous analyses with aggregated values.

If these analyses or profiles are personal, they will be deleted or anonymized upon termination by the user, otherwise after two years from the conclusion of the contract. Furthermore, overall business analyses and general trend determinations are created anonymously where possible.


Comments and Contributions

If users leave comments or other contributions, their IP addresses may be stored for 7 days based on our legitimate interests in accordance with Art. 6 Para. 1 lit. f GDPR. This is done for our security, in case someone leaves unlawful content in comments and contributions (insults, prohibited political propaganda, etc.). In such cases, we ourselves could be held liable for the comment or contribution and are therefore interested in the identity of the author.

Furthermore, we reserve the right to process user data for the purpose of spam detection, based on our legitimate interests pursuant to Art. 6 Para. 1 lit. f GDPR.

On the same legal basis, in the case of surveys, we reserve the right to store users' IP addresses for the duration of the survey and to use cookies to prevent multiple votes.

The data provided in the context of comments and contributions will be permanently stored by us until users object.

Comment Subscriptions

Subsequent comments can be subscribed to by users with their consent in accordance with Art. 6 Para. 1 lit. a GDPR. Users receive a confirmation email to verify that they are the owner of the entered email address. Users can unsubscribe from ongoing comment subscriptions at any time. The confirmation email will contain information about the revocation options. For the purpose of proving user consent, we store the registration time along with the user's IP address and delete this information when users unsubscribe from the subscription.

You can cancel your subscription at any time, i.e., revoke your consent. We may store the unsubscribed email addresses for up to three years based on our legitimate interests before deleting them, in order to be able to prove a previously given consent. The processing of this data is limited to the purpose of potentially defending against claims. An individual deletion request is possible at any time, provided that the prior existence of consent is simultaneously confirmed.

Contacting Us

When contacting us (e.g., via contact form, email, phone, or social media), user data is processed for the purpose of handling the contact request and its processing in accordance with Art. 6 Para. 1 lit. b) GDPR. User data may be stored in a Customer Relationship Management System ("CRM System") or similar inquiry management system.

We delete inquiries when they are no longer necessary. We review their necessity every two years; statutory archiving obligations also apply.

Hosting and Email Dispatch

The hosting services we utilize serve to provide the following services: infrastructure and platform services, computing capacity, storage space and database services, email dispatch, security services, and technical maintenance services, all of which we use for the operation of this online offering.

In this context, we, or our hosting provider, process inventory data, contact data, content data, contract data, usage data, meta- and communication data from customers, interested parties, and visitors to this online offering, based on our legitimate interests in providing this online offering efficiently and securely, in accordance with Art. 6 Para. 1 lit. f GDPR in conjunction with Art. 28 GDPR (conclusion of a data processing agreement).

Google Analytics

Based on our legitimate interests (i.e., interest in the analysis, optimization, and economic operation of our online offering within the meaning of Art. 6 Para. 1 lit. f. GDPR), we use Google Analytics, a web analytics service provided by Google LLC ("Google"). Google uses cookies. The information generated by the cookie about users' use of the online offering is usually transmitted to a Google server in the USA and stored there.

Google is certified under the Privacy Shield Agreement, thereby offering a guarantee to comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

Google will use this information on our behalf to evaluate the use of our online offering by users, to compile reports on activities within this online offering, and to provide us with other services associated with the use of this online offering and internet usage. Pseudonymous user profiles can be created from the processed data.

We only use Google Analytics with IP anonymization activated. This means that users' IP addresses are truncated by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there.

The IP address transmitted by the user's browser will not be merged with other Google data. Users can prevent the storage of cookies by adjusting their browser software settings; users can also prevent Google from collecting the data generated by the cookie and related to their use of the online offering, as well as Google's processing of this data, by downloading and installing the browser plugin available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

Users' personal data will be deleted or anonymized after 14 months.

Google Universal Analytics

We use Google Analytics in the form of „Universal Analytics“. „Universal Analytics“ refers to a Google Analytics method where user analysis is based on a pseudonymous user ID, thereby creating a pseudonymous user profile with information from the use of various devices (so-called „cross-device tracking“).

Online Presences on Social Media

We maintain online presences within social networks and platforms to communicate with active customers, interested parties, and users there, and to inform them about our services. When accessing the respective networks and platforms, the terms and conditions and data processing guidelines of their respective operators apply.

Unless otherwise stated in our privacy policy, we process user data if they communicate with us within social networks and platforms, e.g., by posting contributions on our online presences or sending us messages.

Integration of Third-Party Services and Content

Within our online offering, based on our legitimate interests (i.e., interest in the analysis, optimization, and economic operation of our online offering within the meaning of Art. 6 Para. 1 lit. f. GDPR), we use content or service offerings from third-party providers to integrate their content and services, such as videos or fonts (hereinafter uniformly referred to as "content").

This always requires that the third-party providers of this content perceive the users' IP address, as they would not be able to send the content to their browsers without the IP address. The IP address is therefore necessary for the display of this content. We strive to use only content whose respective providers use the IP address solely for the delivery of the content. Third-party providers may also use so-called pixel tags (invisible graphics, also referred to as "web beacons") for statistical or marketing purposes. Through "pixel tags," information such as visitor traffic on the pages of this website can be evaluated. The pseudonymous information can also be stored in cookies on the users' device and may include technical information about the browser and operating system, referring websites, visit time, and other details about the use of our online offering, as well as be linked with such information from other sources.

Google Maps

We integrate maps from the “Google Maps” service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. The data processed may include, in particular, users' IP addresses and location data, which are not collected without their consent (typically given through their mobile device settings). Use of Facebook Social Plugins

Based on our legitimate interests (i.e., interest in the analysis, optimization, and economic operation of our online offering in the sense of Art. 6 para. 1 lit. f. GDPR), we use social plugins ("plugins") from the social network facebook.com, operated by Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook"). The plugins can display interaction elements or content (e.g., videos, graphics, or text posts) and are recognizable by one of the Facebook logos (white “f“ on a blue tile, the terms "Like", "Gefällt mir" or a “thumbs up” sign) or are marked with the addition "Facebook Social Plugin". Facebook is certified under the Privacy Shield Agreement, thereby offering a guarantee to comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt0000000GnywAAC&status=Active).

When a user accesses a function of this online offering that contains such a plugin, their device establishes a direct connection with Facebook's servers. The content of the plugin is transmitted directly from Facebook to the user's device and integrated into the online offering. User profiles can be created from the processed data. We therefore have no influence on the scope of the data that Facebook collects with the help of this plugin and inform users accordingly based on our knowledge.

By integrating the plugins, Facebook receives the information that a user has accessed the corresponding page of the online offering. If the user is logged into Facebook, Facebook can associate the visit with their Facebook account. If users interact with the plugins, for example, by clicking the Like button or submitting a comment, the corresponding information is transmitted directly from their device to Facebook and stored there. Even if a user is not a member of Facebook, there is still a possibility that Facebook may obtain and store their IP address. According to Facebook, only an anonymized IP address is stored in Germany.

If a user is a Facebook member and does not want Facebook to collect data about them via this online offering and link it with their member data stored on Facebook, they must log out of Facebook and delete their cookies before using our online offering.
